Thought that I could just let the site rest, so wrong!

Counselors having to work almost 12 hours with only 1/2 an hour for lunch and no breaks, the head Queen trying to pass policy that would make it a violation to make fun of her or spread rumors about her. They ain 't rumors from what I heard just the truth that the head Queen does not want people to know about.

Have been meeting with numerous people and will soon start gearing up to defeat the bond election that the his highness Schechter rushed up to vote on before the newly elected trustee Robinson came on board and start questioning the tactics used by Schechter to stiff the taxpayers and students.

I will be changing the site to a different format, but I am still catching up as I purchased new software and still in the process of updating the sites that make money for me.

Houston Community College (HCC) Foundation

A full page ad in the Houston Chronicle and an editorial in the op section by the Houston Community College Foundation, but there is some thing that smells at the Foundation. Below you will find that for the last two years they have refused to submit documents to the Better Business Bureau, recently an open records request was made and or request for inspection of documents. There is a question as to whether they may have to provide documents via Open Records, but there is no question that they have to make documents available for inspection. I had several people tell me during the Spring Branch annexation that Foundation funds were used to promote the annexation (I have no proof that they did but the people are reliable sources). Recently an open records request and request to inspect documents was made of the Foundation, have had no response to date. A request for production of a check that allegedly made to the Foundation for the use of Houston Community College system property was made. The Northeast Campus was allowing persons to race vehicles on the track located on their campus and charging people for the use of the track. The money paid was allegedly going to the Foundation, why? The tract was built in part with Federal Money why is the money not being used by the Community College? Why is it going to the Foundation?

Make your voice heard quit giving money to an organization that is not transparent as to how it uses the money it receives. Say NO the Houston Community College Foundation.

After a year Firefox finally has an Okay by my site, hooray! It was not easy as I had people reporting my site as unsafe and a source of malicious viruses.

HISD, I ain't got a a beef with HISD but some of my sources are telling me that Texas Watchdog is going after the wrong person, Manuel Rodriguez. I hear that the persons involved in getting Morganti contracts are Republicans, they gave me their names but I have enough on my plate. According to my sources Manuel Rodriguez is being set up because he does not get contracts for people and they want someone that will help them, so my sources say.

Complaint with DA filed and interviews continued

On Monday October 3rd a sworn complaint was filed with the District Attorney's office of Harris County. The complaint alleged violations of the competitive bid laws of the State of Texas. The complaint alleges that HCC through its administrators and trustees engaged in behavior that circumvented the bid laws of Texas. Thus far complaints have been filed with three agencies.

It is my understanding that there are law enforcement agencies that are monitoring this site and they want all the Veselka file, one law enforcement agency has it the others will have to get it piece meal until they ask for it directly.

Art Tyler made a big deal about the Chevron contract when he was going after former trustee Abel Davila. Art Tyler never expected for this report to become public consequently he did not think things through as to what would happen if the report became public. Art Tyler in his interviews and documentation implicates himself and Mary Spangler with possible criminal actions when they may have conspired with others to circumvented the Texas bid laws. Here is Art Tyler's interview again. On page 2 second to the last paragraph you find Art Tyler stating that he, Mary Spangler, Abel Davila, Jarvis Hollingsworth, and Chevron officials were meeting in February 2009 to discuss the percentage of the contract to go to minorities. Why were they discussing that with Chevron? How did they know that Chevron was going to get the contract? The Request for Qualifications did not go out until May of 2009! There is fire here and they cannot hide nor run away from their statements.

Side comment: Channel 13 undercover on Constable Trevino, continues a pattern of Dwayne being the goffer for powers that be. Dwayne has a history of being nothing but a gopher, he could not do a story if he depended on himself. There are much bigger fish but he goes after the little guy quite often the minorities. Bob Lanier used him to win a mayor's position.

From the Rumor Mill

"Since you published about the new police office at 3100 Main, Chief Greg Cunningham has read the insider.  He told his staff the reason he needs to have a private bathroom and shower is because the nature of his work as a police chief.  Cunningham said he never know when he would be working on some crime and has to work all night and could not go home and shower and shave for the next days work.  Well this is a crock, no chief of police for HCC works all night long unless Houston has a hurricane.  That is a very expensive shower that may happen one time in a 5 to 10 year period.  Also the move did not take place on Sept. 12th, the police office is not finished as of yet, maybe another two weeks.
 
I understand that Doctor Art Tyler, Jr., is in Qatar this week.  He was taken to the airport by the HCC Police Department. Another expensive trip. 

I also see at the last board meeting that they voted a large settlement for Doctor Carolyn Glass, the ex CO of the Katy Campus.  She will retire Monday, Sept. 19, 2011.  She was moved to 3100 Main from Katy Campus after 28 years of employment with HCC, at the end of June.  To keep from filing a law suit she has been xxxxxx xxx xxx a xxxx settlement from the board with the recommendation from Dr. Tyler.  That means she has signed an agreement not to reveal any conditions of the agreement are the amount in lieu of suing HCC", unknown source cannot verify as to the truth to some of what is stated, Inside HCCS

The report that I am hearing is that Richard Schechter and Michael Williams were extremely rude to the persons that went to speak against the tax hike. The HCC Board purposely start the meeting when most people are not able to attend and than both Richard Schechter and Michael Williams resort to mistreating individuals that do not agree with them . Those two scoundrels should tender their resignation as Trustees as they are unfit to serve.

A Tale of Two Restrooms by concerned taxpayer

In light of the budget shortfall, frozen positions, cuts of faculty and staff salaries how can HCC justify using funds to build a full restroom for Betty Young @ Coleman College and Greg Cunningham @ District Police Department.
 
At Coleman, the public restroom for females are only about 30 feet from President Young's office suite.  The space used to construct her restroom was originally part of a large classroom that was slated to be converted into a videoconferencing classroom.  The video conference classroom is part of a Title-III federal grant.  The classroom had to reduce it's capacity to accommodate the presidential potty.  This is in light of increasing enrollment and larger class size being urged.
 
At District, a new suite for HCC Police administration was built out on the first floor of the parking garage, and Chief Cunningham got his own private restroom.  In addition to two interrogation rooms and steel vaults.  This is the same Chief of Police that had questionable credentials and his mismanagement has resulted in several lawsuits that will divert funds from student success and other deferred maintenance issues to payoff settlements.  So his reward for being a poor law enforcement leader is his own personal restroom.
 
How do these restrooms figure in with the strategic plan, how will the help student retention and student success.  Do the taxpayers know their taxes are covering personal restrooms?

If you are against the HCC tax increase and can not make the September 15 meeting to speak against the tax hike than contact Board Services at board.services@hccs.edu , here, is the same link. Here is the number to Board Services, 713.718.5025. If you are one of the lucky persons that can take off from work to attend the meeting, sign up to speak at the regular meeting as the meeting is videotaped, the tax part of the meeting starts at 3:45 and the regular meeting starts at 4:00 p.m. Be prepared to have someone from HCC (usually the Board Counsel) call and try to dissuade you from speaking and to give you the first amendment warning that your first amendment rights stop when you enter HCC. You will not be allowed to refer to any of the trustees by name (they are like God and one can not say their name in vain while speaking to them). If you violate the rule expect to be escorted out by their Gestapo. If HCC sees that there is a long list of persons signed up to speak expect them to move the speakers to the end of the meeting.

Richard Schechter is unopposed and he wanted to make sure of that. That is the reason, my opinion, that he made sure that the subject of a tax increase was not addressed until after the deadline. Thus far they have increased tuition, cut salaries, reduced employees and/or hours worked, found $9,000,000 to purchase a piece of land that they have no need for. Guess how much HCC is short? $9,000,000 surprise surprise surprise. The foxes are watching the hen house and the taxpayers monies are not safe.

Last Week I posted that HCC was going to vote to increase property taxes and they did on Thursday

If the Board of Trustees are voting to increase taxes why are they buying a piece of property for which they have no plans for? Richard Schechter and the trustees can find $9,000,000 to purchase the Westheimer property. Richard Schechter and the Trustees can find hundreds of thousands of dollars to fight a lawsuit to stop the purchase of the Westheimer property at an outrageous cost, way beyond the appraisal value. Richard Schechter and the Trustees can find money and applaud spending taxpayers money advertising on National TV. Richard Schechter and the Trustees tolerate hundreds of thousands of dollars on trips to Qatar. Richard Schechter and most of the Trustees are voting to spend taxpayers monies like drunken sailors. The Board meeting was held on August 18, 2011. Two weeks later they met as a committee of the whole and decided to vote for a tax increase. They waited until after the deadline for filing to bring the bad news to the taxpayers. Richard Schechter and the Trustees are playing games.

Next week the Chevron contract where the administration engaged in what I believed in possible corruption, fraud, waste, or abuse of power will be submitted to the Harris County District Attorney, the FBI, and probably the FT. Bend District Attorney (HCC is in Ft. Bend County). It has already been sent to the Texas State Auditor.

The FBI: Yesterday I received a call and was told that the Houston Comical had written a story on an FBI investigation, here. Let me tell you the difference between what that tabloid writer did and what a true reporter would have done. A true reporter would never have had a headline that reads, "FBI investigates possible corruption at HCC." That may or not be a true statement as the tabloid writer Mellon does not know for sure that the FBI is investigating, but she writes the headline as it were true. Do Not believe anything that the Chronicle writes on HCC. For instance the part where Eva Jackson has received about $50 million dollars in contracts from HCC is not true. Let me repeat that it is not true. Did she have contracts worth several millions yes! But not even close to what the tabloid has written. Here and here are the two agendas for the month of May 2007 read them for yourself and do not let a tabloid writer influence your judgment of Gloria Walker or Eva Jackson.

Hopefully I will receive a document that will paint another picture of what occurred and it may be a big surprise for a one special person.

The issue of RHJ and Alief project was not an issue when Veselka conducted the investigation as one can see that no questions were raised regarding the issue with Ms. Walker or any other person. Art Tyler is, I believe, is the only one that brought it up on his interview. So why is it an issue now? My theory is that HCC wants to reflect attention from itself to others, like trying to suggest that Abel Davila was the one pushing the Chevron Contract. There are some people at HCC that may in serious problems, my opinion, and they are sending smoke signals to their allies (Houston Comical) to have people look else where hoping to divert attention to what they have done. Ask yourself this question?

Board votes for Tax Increase

On Thursday the committee of the Whole at HCC voted to increase property taxes, the Houston Comical through its' tabloid reporter were there but failed to mention that story. Why is HCC increasing property taxes? Just a meeting ago the Board Chair was bragging how they balanced the budget without a property tax increase. Only two Board Trustees voted against the tax increase Yolanda Navarro Flores and Sandie Mullins. My opinion, there is money that is unaccounted for and as long as the foxes are in charge of the hen house we will never know how many hens are missing. Things are so bad that HCC redacted the location of funds used to purchase certain properties, that is taxpayers' money and they do not want people to know how they are spending taxpayers' money. What are they hiding? Mr. Transparency Richard Schechter I have had at least five open record requests sent to the Attorney General since you became chair, where is the transparency? Ms. Sane not to long ago you stated that you would not vote to use general funds to buy property but than turned around a few weeks later and did so. Mr. Austin you let an administrator take charge, said administrator in my opinion is not qualified, what happened to you? Ms. Mullins you have a Republican district, beware that in a few years and they come quickly the pct judges will be made aware of how you have conducted yourself. Ms. Sane and HCC you promised that Alief would not be split, you broke your promise.

I have had the opportunity to speak to some of the people who were interviewed and it seems that much of what was discussed was omitted in the final report. From the same persons that I spoke to it seems that there were no audio or video of the interviews, there were no court reporters just people taking notes this is very subjective type of note taking in my opinion.

Why did Mary Spangler not bring up the fact that she had a long history with Chevron? Why did Mary Spangler not mention that her and Art Tyler had formed a company called ICEPS? Why did compliance not find that Mary and Art had a company? Why did Compliance not find that Bruce Austin had conflicts as well? Why did Compliance not find that Chris Oliver made $18,000 disappear without a trace?In my opinion Compliance goal was to go after the Latinos. Compliance is still not doing its' job as it failed to find that Chris Oliver did not even bother to sign his campaign report. Here is the report go to page 2 and notice that where it says signature of candidate Chris Oliver did not sign it. According to the Chronicle and Texas Watchdog when people give money there may be a connection with contracts and the trustee, so go to page 3 and notice that first name. Karun Sreerama gave $5,000 to Chris, then look at all those law firms who also gave a lot of money. ESPA used to belong to, here is the history. Guess who worked and still works for the former owner of ESPA, Bruce Austin, surprise, surprise, surprise.

So Mary Spangler why are you not authorizing a Lawyer to go after Chris Oliver? Why did Mary Spangler not mention that Art Tyler had also had some controversy regarding a golf course, here? Mr. Tyler where is that medal, still waiting for you to show it off.

From the rumor department

Seems that there may have been a cut in pay for at least one person and a move to a campus from administration. The rumor is that the employee and a top administrator almost got into fisticuffs over the failure of the employee to either properly do a personal chore or not doing it properly. Normally, my opinion, this would result in administrative punishment but the employee knows too much about the higher up so moving them was the safest thing to do.

Someone contacted me and stated that they have a video of a Trustee and a Vender being very cozy at an Astros game, thus far they have not sent the video.

Here are all the HCC campaign reports courtesy of Of The Kuff. Wonder why the person from Watchdog did not catch the failure of Chris Oliver to sign his campaign report? Why did Kuffner not catch that error? My opinion they are called reporters because they write what is spoon fed to them that is why reporters from the Chronicle and Watchdog tend to publish so many errors and blogs like Off The Kuff perpetuate the error so soon the lies become truth. If one bothers to look at the campaign reports look at Karun Sreerama and how much he gave to the trustees.

Michael Williams did not file for City Council at large so I guess that gets him out of politics and hopefully he will ask God for guidance and forgiveness for what he has done as an HCC Trustee. From the rumor department I had heard from several sources that the feds were very interested in Michael. I guess he heard the same thing, anyhow they are rumors.

Yesterday morning while reading the Houston Comical, yes I still pay to read the tabloid. I have to keep up with the dark side, while reading the tabolid I read their editorial and burst out laughing so hard that my wife thought I was crazy. The part that made me laugh was

"And will it be expensive? Yes. (For a similar inquiry, Houston Community College, which is about a third the size of HISD, spent more than $335,000.) But given the extraordinary sums of money involved in HISD's contracts, and the seriousness of questions about the way the district spends its money, the cost of a thorough investigation would be money well spent."

The people at the Editorial Board must be asleep or on something as you don't hire your friends (the lawyer hired was/is a friend and/or close acquaintance of Richard Schechter- Board Chair- Mr. Transparency) one does not hire lawyers to do audits, you hire independent CPAs or auditing firms to do that you may also hire lawyers to review the report to make sure that everything was done legally. Of course that does not stop fraud remember Enron.

My opinion of the Comical is that they are running one of the biggest extortion rackets in town. If HISD wants to stop the editorials start buying advertisement in the Comical, that is what HCC does. HCC recently has been purchasing advertisement in the West University paper and whola articles on how bad the Latinos at HCC started getting front page online room. I want to add that I have had companies offer to buy ads and have declined them as I do not want to compromise myself. Besides I fail to understand why HCC will vote to increase property taxes today but keeps paying well in excess of $1,000,000 dollars a year on advertisement. Why do they need advertisement?

On the tax increase this is the line they will probably use, last year HCC received $100,000,000 in property taxes, this year we will again receive $100,000,000 in property taxes therefore there is no increase. BS you have to raise the property tax rate to get the same amount as the value of the properties have declined. I am taking bets that the idiots at the Chronicle and the other media fall for the line. The $100,000,000 is a rounded number for illustration purposes only but it is close based on last year taxes.

Chevron Continued

Here is an interesting story by Texas Watchdog. Recently Texas Watchdog stated that Abel Davila was the person who pushed the Chevron Contract, I take issue with that statement as all evidence that I have gathered points to the Mary Spangler administration. Texas Watchdog also seems to lump campaign contributions with possible corruption (my take on the story) if that is so than ESPA or what used to be ESPA makes that money mentioned in the Watchdog story look like chump change and of course the large law firms that give thousands of dollars are beyond reproach they are only interested in good government, but the minority person who does it has ulterior motives. I maintain that they both do it for the same reason and get contracts for the same reason that the big White law firms get contracts. I, also, take issue with the lie published by Watchdog about Trustee Flores son. Trustee Flores son did not have a contract with HCC, the Veselka report did not make that finding in fact Veselka and HCC had proof that Trustee Flores' son did not have a contract before they even launched the investigation. The report, however, was worded as such as to make it seem that her son did have a contract.

Larry Veselka's interview of Jarvis Hollingsworth (Board Counsel HCC)

1) Hollingsworth states that he does not get involved with RFQs or RFPs, however, Art Tyler, Mary Spangler, and Abel Davila all have him at meetings in February and March of 2009 where they were discussing the Chevron Contract and subcontractors. There are two problems here, how in the heck did they know that Chevron was going to get the contract as they did not post the RFQs until May 1, 2009. I have reason to believe that HCC may have circumvented State procurement laws by pre-selecting the Vender prior to the posting for RFQs. I have sent a complaint to the State Auditor and similar complains will soon go out to other agencies and media. The other problem, is assuming that I am correct about pre-choosing the vender, is did Hollingsworth have a duty to inform the Trustees and Administration that they may be violating the law. That is a question that is asked of the State Bar of Texas.

2) Concerning Chris Oliver, Trustee, Hollingsworth states that Chris Oliver should have known that he had a duty to disclose his relationship with Ft. Bend Mechanical.

Within two weeks I will have all the documents ready on Chris Oliver, I have a friend that is going to file a complain with the DA of Harris County.

Once again we have a Board Trustee pointing a finger at Art Tyler. On Tuesday (taking the Labor Day Weekend) I will post Jarvis Hollingsworth interview. This one is interesting not because of what was said but because of what was not said.

The other things of interest are that Bruce Austin states that Chris Oliver knew he was a subcontractor with Ft. Bend and did not recused himself from voting. It seems that Chris Oliver and Art Tyler according to Bruce are very close Golf buddies and that Art Tyler may be favoring companies that Chris Oliver may prefer.

Thus far we have Renee Byas saying that Art Tyler wanted the Chevron Contract ASAP. We have Chris Oliver stating that Art Tyler made the recommendations. We have Randhir Sanhi stating that the Energy Contract that went to Chevron only had one week posting. We now have Abel Davila suggesting that Art Tyler was the one pushing for Chevron. Thus far all the fingers all point at Art Tyler. Remember that the Administration of Mary Sprangler of which Art Tyler was a part of has a history with Chevron Energy Solutions going back to 1999, here, Viron is now Chevron Energy Solutions.

I also want to point out two persons have now stated that Alan Johnston had a report on the energy savings, Art Tyler and Abel Davila. That report is import because I have requested a copy of that report and HCC does not seem to have it. Did they lose or destroy a government document?

RHJ and the Chronicle

Remember that hatchet job done by the Chronicle on RHJ a minority owned company, here. In the story the RHJ owner (Eva Jackson) states that HCC does not want to give a contract to RHJ so that is probably the reason that all this about her company is appearing now. Well there is some truth to the statement as RHJ was the low bidder on the Stafford Campus Contract. Below are the bids submitted by various companies. No wonder that HCC may be attempting to raise property taxes, they pay too much for properties and refuse to give contracts to low bidders because of personalities. Board of Trustee the money you waste belongs to the taxpayers of Houston. I want to remind people that being friendly with elected officials or being their friends does not make one corrupt because they get a contract or hired. The Chronicle always seems to imply that is the case, especially when it comes to minority owned companies.

Rumors

Rumor 1) I was told that there may be a special meeting of the Board next week to discuss increasing property tax. Hope that is not true as just a couple of weeks ago HCC found $8,300,000 to buy a piece of property for which they have no plans for at the present. HCC is paying probably in excess of $2,000,000 a year in attorneys, not including settlements (I heard that the EEOC has just found that HCC was guilty of racial discrimination and retaliation.). Over a million dollars a year in advertising. Half a million on two chancellors that seem incapable of running the College. Half a million dollars on lawyers to harass one current and one former Board Trustee (resulting in another lawsuit). A year ago when I was writing that HCC was not preparing for the cuts from the state and in property taxes, I was made fun off by the Board. Who is having the last laugh? They are spending $1.3 million a year to pay for the chevron contract and may be realizing only $600,000 in energy savings. I don't believe that HCC has made any money in the Qatar venture in fact they are probably losing money, but one can not find out as HCC does not know what the costs are.

Rumor 2 From an email sent to me) The new HCC Police office located on the first floor of the parking garage at 3200 Main, is due to be occupied Sept. 12. 2011.  This is a very large expensive police office.  Chief Cunningham had the contractor makes his office larger by knocking out a wall and taken in a smaller office adjacent to his.  The new police office has one unisex bathroom.  Chief Cunningham office has a private bathroom and shower for Chief Cunningham. Two walls of Cunningham are also bullet proof glass. The police office has also added two large walk in vaults and one large storage room. Not sure what the police office needs with two walk in vaults with combination.  Crime must now be bad at HCC.  HCC police has never had anything that would take up that much room.  The police officer also has two interrogations rooms, with one way glass.  Don't know who HCC plans to interrogate and how many at one time.  It has also one large lobby.  HPD would love to have a station with such amenity's.  It seems that money was no object for Dr. Tyler to pay for such elaborate police office.

Ms. Renee Byas is General Counsel for Houston Community College. Here is the Renee Byas interview. Please pay attention to a particular statement that Ms. Byas makes concerning Art Tyler and the Chevron Solutions Contract. I have highlighted two sections that I consider important;

1) Ms. Byas felt some pressure from Art Tyler on getting the Chevron Contract approved as soon as possible;

2) The remarks from Jarvis Hollingsworth to Ms. Byas in regards to Trustee Chris Oliver.

The first statement is of particular interest as someone has been stating to the Media that Abel Davila was the one pushing the contract. If you have been a regular reader you will recall that Mary Spangler has had a relationship with Chevron (used to be Viron) going back to when she was chancellor at Los Angeles Community College, here.

The Second part is is also of interest because of the call to Chris Oliver, Chris Oliver signed a conflict of interest dated April 21,2009. Chris Oliver was a subcontractor for Ft. Bend Mechanical at least going back to early March 2009, here are the payments to his company. Notice this email dated April 7, 2009. This email selecting the subcontractors for Chevron was sent prior to the Request for Qualifications on the Energy Contracts(Let me spell it out how did they know that Chevron was going to get the Contract?). On May 21, 2009 Special Board Meeting, here, Chris Oliver participates in selecting Chevron to perform the energy savings contract. Remember that Chris had just signed a conflict a month earlier stating he had a conflict as to Ft. Bend Mechanical. How can Chris Oliver claim ignorance when there is an email directly tying him to Ft. Bend Mechanical as a subcontractor to Chevron?

It all depends on the slant ones puts to the story

Read this story that is on the Sunday's Chronicle newspaper and one comes away with the impression that the people involved are corrupt. The comments that follow the article certainly seem to suggest so. There is one person that is quoted (Jay Aiyer) by the Chronicle and the link provided seem to cast said person in the best light possible, so I want to help balance the story by providing this link.

I know I promised that I would have Renee Byas interview today but instead will substitute the Randhir Sandi/Jay Aiyer interview, the interview is here.

One has to remember that the Larry Veselka report was compiled to go after three Latino HCC Board Trustees and the report was never meant to become public. I want you to notice some things that are in the interview;

1) That Jay Aiyer represented Randhir Sahni as the attorney for Mr. Sanhi. It is not clear if both Mr. Sanhi and Jay Aiyer were present (by phone) but the responses seem to suggest that they were.

2) Mr. Sanhi mentions that he received a call from an engineer who wanted them to participate on the Chevron Energy Performance Contract but the Request for Proposals was due in a week so they did not go with it.

3) Mr. Sanhi participated in Dr. Tyler's informal audit of what was spent on the Alief project. This may be part of the memo that HCC does not want to release. Question for Mr. Richard Schechter, what happened to we want to be transparent?

4) What is of particular concern is the last paragraph on the Alief Project "Mr. Sahni met Alan Johnston a couple of times. They had one meeting regarding effort on the Alief project where Mr. Johnston attended. Mr. Sanhi was taken off the project. He heard from Winston Dahnse that the architect on the job went to a trustee who told the Chancellor Mr. Sanhi should not work on project or attend meetings." This is of particular concern because the company in which Mr. Sanhi is president was involved in the Alief Project, here. The firm of Llewelyn-Davis-Sanhi in fact does quite a bid of work for HCC, here, here, here, and here.

Lack of Leadership from the Board and Administration

What I personally fail to understand is how many of you that have personal knowledge of wrong doing sit idly there hoping that you survive. I admit that I am disgusted not just at the Board and Administration, but also the faculty that has no courage to do what is even right for themselves.

Why the hurry to spend HCC taxpayers monies?

Following is a video approximately fifteen minutes long, I realize that it is much longer than most people care to watch, especially anything as boring as a meeting of elected officials. The meeting concerns the purchase of a piece of property for what some people believe is way beyond the value of said property. View the video and ask yourself does it pass the smell test? Why are the other Board Trustees not participating other than raising their hands when ordered to?

If you do watch the video toward the end the person that did the appraisal mentions the Super Target at the corner of Eldridge and Westheimer. Interestingly the appraiser did not compare the price of the property where the Super Target is located so I asked some friends that are in the business of selling real estate and they told me that the land where the Super Target sits sold for $4 a square foot, that is half of what HCC is paying for some land that is not as in a prime location compared to the Super Target land. I ask again why is HCC so gung ho in purchasing this property at this time?

The other thing that my friends mentioned is that the land that HCC is purchasing is in the flood zone, so HCC will have to do some remediation and the appraiser failed to include that in what the land is worth. So why is HCC so gung ho in purchasing the property? If I were a person who believes that politicians tend to be corrupt I would think that someone is making money on this deal, but I know that everyone at HCC is an honorable person.

My goal at Inside HCCS is to bring light to what is and has been occurring at Houston Community College. If HCC thinks that they will ask Katy taxpayers to vote for annexation; if HCC thinks that they will go out for bonds; if HCC thinks that they will present the face they want to present to the public without any input they will be surprised. As to HCC posting campaign reports online based on Richard Schechter's word, all I can say is Kuffner do not hold your breath. In fact if Kuffner bothers to watch the video he will see that Richard Schechter runs the dog and pony show, so if Richard Schechter wanted the campaign reports online they would already be online (My 2 cents).

Most other blogs gather information from other sources and basically repost with commentaries, my goal is to bring original information not found any where else.

Apples and Oranges or spending $8.3 Million because they can (Westheimer Property)

On August 18, 2011 the HCC Board voted to rescind its' previous vote of purchasing the Westheimer Property by borrowing money. Richard Schechter, below, led the seven dwarfs in an exercise of doing something because they can. Richard Schechter and the seven dwarfs than voted to pay cash for the property. Where is HCC coming up with $8.3 million? At the same Board Meeting they patted themselves on the back that they passed a budget that raises student tuition and fees. At the same Board Meeting they patted themselves on the back because they balanced the budget on the back of the faculty and staff. So what is HCC going to do with the property? Who knows as they have no intent to build anything at the moment. If possible I will upload the full video part of the Board action tonight. Dave Wilson who has filed a lawsuit to prevent the purchase of the land as it may constitute Waste, Abuse, and possibly Fraud may be circumvented by the HCC Board. Richard Schechter why are you and the seven dwarfs so adamant on purchasing the property if you do not know what you are going to do with it? What Richard Schechter and the seven dwarfs have not gotten through their pea brains is that the money they are spending does not belong to them, they are trustees for the taxpayers.

There has already been a complaint filed as to the appraisal done on behave of HCC. Why can't HCC wait until the complaint is heard by the Appraisal Board?

Why can't HCC wait until Dave Wilson is given an opportunity to have his own appraisal done, he is in the process of doing that?

What is the urgency in purchasing the property? Is someone making money on the deal? Is it because the Board has gotten so egotistical that they believe that they now believe that they and only they know what is good?

Rumors

A high level executive secretary got herself fired by trying to do the right thing. However, the powers that be had second thoughts and rehired the executive secretary and placed the person in a different position at the same pay. My thoughts the executive secretary knew too much.

Milking the System and Rumors

Below is the response that HCC sent me in regards to an open records request. I normally would have not posted this type of response but HCC went out of the way to try to make it difficult for me to save as a pdf so I decided to share it. Why would a trustee be filing worker's compensation claims? Email your Board member and ask them to investigate.

I had a request from the Chronicle to share some information that I had regarding RHJ. The interesting part is the rumors that I am hearing is that that it is the folks at HCC that are providing the information to the Chronicle regarding Marshal, Harris, and RHJ. Why would they do that? I believe it is to take the heat of HCC.

Some good news for Johnjay the HCC police officer that was railroaded (my opinion based on facts that I have). Rumor has it that one of the HCC officers that was a witness against Johnjay may have rape charges filed against him.

EL PASO, Texas (AP) — The superintendent of a large West Texas school district has posted bond a day after his arrest on federal corruption charges.

El Paso School Superintendent Lorenzo Garcia was to be released after posting a $50,000 bond Tuesday.

A federal indictment accuses Garcia of steering a $450,000 no-bid contract to a friend. The 55-year-old administrator faces two conspiracy counts, one mail fraud count and one count of theft of federal funds.

The indictment unsealed Monday says Garcia falsely presented his co-conspirator as the only provider of goods and services in order to secure the contract with the school district.

He has pleaded not guilty through his attorney, Ray Velarde, who expressed confidence that Garcia will be vindicated.

I have been posting for almost a year now with close to half a million hits, I am close to wrapping it up as I have neglected by hobby and my family. I will not be posting as much as I intend to take my findings to the proper authorities. I will be filling a complaint with SAC before the end of the year. Thank you for visiting. There are still some loose ends that need some explaining from Houston Community College and have and will continue to file open record requests.

One more thing, Trustee Yolanda Navarro Flores was the only Trustee that was asking questions, she has been beaten down by the constant hammering by the other trustees. They spent almost Half A Million Dollars trying to stop her and they have succeeded to a large degree. Most of the faculty at HCC is gutless and want others to fight their fight, that is not the way things work there is strength in numbers. Do Trustee a Flores send an email to Board Services, Here, tell her thank you. Yolanda as well as Abel Davila are friends that I have known for 20 years and I am not embarrassed to call them friends.

I got involved because HCC made a mistake in believing that they could just give names to the Chronicle and that every one would just stand back and take it, they should have asked about me first. I think that before I finish some of the Trustees and maybe administration will rethink what they did.

Art Tyler where is your Medal of Honor with Heroism? One newspaper account states that you earned one, did you? Show us the medal?

Art Tyler you state that in mid-2009 that you created the Office of System Wide Compliance with two lawyers fresh out of law school.

1) If true why is there no report about the creation of Iceps by them till August of 2010? Why did you not report the possible conflict?

2) If true why did Renee Byas state "Toward the end of January 2010, Ms. Byas was doing a due diligence search on a consulting company for Dr. Tyler." Renee Byas is not fresh out of law school is she.

Mr. Tyler explain why the subcontractors for Chevron were already a done deal before the bidding for the contract even went out? Talk about removing the appearance of impropriety by the champion of transparency Richard Schechter.

Mr. Tyler one letter from the Veselka report suggests that one of the subcontractor to Chevron has ties to Ben Reyes, is it true?

Mr. Tyler can you explain why you use HCC credit card to pay for Green Fees?

So many questions Mr. Tyler that need answering.

Richard Schechter why does it appear that you hate Latinos so much or is only certain ones, maybe the kind that don't bow down to you?

Finally I have been talking to some organizations and they seem interested in helping as it was not only the Latino Trustees that they went after, they went after employees also, including Johnjay Portillo, whom I believe was railroaded and is presently fighting an indictment. As one person told me "They are like the Mafia if you cross them they will come after you."

If you want to find out about a person ask who their heroes are, my heros are Zapata, Patton, and Genghis Khan. "It is better to die on your feet than to live on your knees."

Secretaries making nearly $200,000 a year but the faculty bearing the brunt of ineptitude, what a Board of Trustees. Also on the Agenda the Board of Trustees is so happy with the work that the Chancellor is doing that they are thinking of rewarding her by either extending her contract or giving her a pay raise. I maintain that the Board of Trustees may be so inept or corrupt that they will do anything to makes that ineptitude or corruption easier for them. Richard Schechter can not explain why Energy Savings Contract was a done deal before it happened. Explain why Chris Oliver all wrong doings were not on the Veselka Report to the DA? Explain why other Trustees mentioned as interfering with contracts or failing to have conflicts of interest were not investigated? There are too many unanswered questions. See the agenda for today go to item G, here. Be there and insist on the topic of the Chancellor be held in open forum, the chancellor's position is believed by many legal experts to not be covered by the need of executive session.

They knew that the Benefits would be on the agenda and they waited till a Friday afternoon to send an email when most of you are gone, cowards. See what the Administration was saying last year.

Dr. Tyler provided an overview of the college’s financial status. He indicated that as of May 31, 2010, the financial status is excellent. Dr. Tyler recommended taking the entire two-year biennium payback from the current year budget. He apprised that this will leave an ending balance above the required 8 to 10 percent reserve and next year’s budget in tact as previously approved ... found in the June 2010 Agenda, here.

The people in charge either do not understand budgets or they are flat out not being truthful. I have it from a reliable source that Richard Schechter in fact was going to ask for a tax decrease last June but could not find sufficient votes.

1) notice the date on the email, notice the name of the contractor, explain why the subcontractors were already chosen and the request for qualifications had not even posted? The request for qualifications was posted on May 1, 2009. Why do I think that Richard Schechter does not mean it when he states that he wants to remove the appearance of impropriety?

2) Richard Schechter please ask Board Services for a copy of the email I sent you and your fellah brethren; Nearly $20,000,000 for the Chevron Contract that is what it is going to cost the taxpayers.

Veselka Interview with Richard Schechter

"Trustee Schechter first became aware of J's Quality at the April 8, 2010 Board Meeting during executive when they were handed materials revealing Former Trustee Davilas as a Corporate Officer of J's Quality."

Dear Mr. Schechter I did an open record request concerning the above statement and reviewed all the documents that were presented to the Board and found no document that indicated that Abel Davila was "... a Corporate Officer of J's Quality." The Veselka Report did not find that Abel Davila was ever "a Corporate Officer of J's Quality." Did you misspeak Mr. Schechter in your interview with Veselka? Were you mislead by the words and failed to read the documents that were presented, Mr. Schechter?

"Trustee Schechter was shocked to learn in the interview there was a separate contract or maintenance painting. ... He wondered why Dr. Tyler agreed to it."

Dear Mr. Schechter since you like to remove even the appearance of impropriety may I suggest;

1) That you investigate why was "Dr. Tyler" meeting with Chevron prior to the Energy contract going out for bid? You may get your answer as to why Art Tyler agreed to a separate contract for maintenance painting. I would guess that he was rounding up votes to pass the Chevron contract that would be my guess as everything suggests that is what was occurring. Abel Davila wanted to help friends, Chris Oliver wanted to help himself, Neeta Sane wanted to help ____? Richard Schechter wanted to help ____? Michael Williams wanted to help ____? Go down the list and see who got what?

2) Jarvis Hollingsworth was at many of those meeting where discussions on who the subcontractors were going to be on the Chevron contract (It was the Chevron Contract) before the bid even went out.

3) An email states that Trustee Oliver gave a list of the Chevron subcontractors to Art Tyler before the bid went out.

4) Chevron did not receive the highest points but you, Mr. Schechter, voted for Chevron? Why as you normally vote for the company ranked number 1?

Yes, Mr. Schechter there is much to be investigated concerning what occurred during those times, you and your brethren have already had the "Mexicans" investigated so why not the rest of you? Do you have something to hide Mr. Schechter? Do any of your Brethren have anything to hide? In fact I now have some evidence that Chris Oliver knew that Ft. Bend Mechanical was going to be a subcontractor with Chevron, prior to the bid even going out. I do not believe you Mr. Schechter when you make statements like "I want to remove the appearance of impropriety." I do not believe you because your lack of action in regards to doing what is right does not match your rhetoric.

If you, Richard Schechter, are an honest man (unusual for a politician) I would suggest that you read the Veselka Report, read the interviews and look at the exhibits open your eyes to what is happening around you. If you are an honest man Mr. Schechter do that. If you are an honest man and need some help to expidite the search email me here I will guide you.

One more thing Mr. Schechter, it is not illegal or unethical, to recommend friends in fact I have always told people that I know, that are in politics, that it is not illegal to recommend your friends just make sure that they are qualified. You yourself know Brad Deutser (Yaffee/Deutser), Larry Veselka, and Mr. Zimmerman. I know Brad Deutser and he seems to be a very good person and based on my knowledge is very qualified to do what he does for HCC. Mr. Veselka did a fantastic job unfortunately I think you have not bothered to read the treasure trough he left you or Richard Schechter is not an honorable man, I hope it is the former. Mr. Zimmerman was a disappointment because he should have at least invited Trustee Flores to be interviewed. J's Quality after its' initial start had very high ranking from the people at HCC, painting is not rocket science Mr. Schechter. Mr. Schechter I know women and men that lead very successful construction companies that never did construction work, Abel Davila knew what J's quality was capable of doing and wanted to help young minorities get started there is no shame on that. Veselka did not find that Abel Davila benefited from J's contract with HCC so where is the impropriety?

Receiving a lot of information of importance

1) Jarvis Hollingsworth (HCC Board Counsel) whom I believe is the Attorney for HCC was at many of the meetings discussing the Chevron Contract and the subcontractors that would be used. One big problem that I see with that the contract for energy savings had not been posted. Question Mr. Jarvis ain't that like putting the wagon in front of the horse? Is it legal? That is what you are there for, right to make sure that things are kept legal, I may have to ask the Texas State Bar if that is proper, but that is on a to do later plan. It is never to late to step forward, right Mr. Hollingsworth? Art Tyler has Hollingsworth at those meetings. Abel Davila has Jarvis Hollingsworth at those meetings. However when asked about J's Quality Construction (one of the potential subs with Chevron) Mr. Hollingsworth; "No personal knowledge."

During the entire time that this investigation was going on Former Trustee Abel Davila would tell me that "Jarvis was there", Jarvis knows that is not what happened. I have seen Abel Davila age about 10 years because of this ordeal, he was forced to move from the community because was hounded by HCC Trustees and Administration. Now I get additional proof that "Jarvis was there" but Jarvis states I know nothing, I see nothing, I hear nothing, I saw nothing. Mr. Jarvis if Abel was telling the truth and right now I tend to believe him, you could have stopped all of this. This nightmare for Trustee Flores and Davila could have been stopped by you. What would your partners think if they found out?

3) Dear Richard Schechter and HCC Trustees;

I do not know if you intend to defend the injunction to prevent the purchase of the property on Westheimer, but if that is that your intent to defend the purchase why not do the taxpayers a favor and investigate whether HCC is getting a good deal. If it is not a good deal stop the purchase, you are the bosses not Art Tyler and not Mary Spangler. Grow up, grow some, and do what the taxpayers expect of you.

Decided that I will also put together a packet on Chris Oliver to present at the same time as the packet on Chevron, see below. The evidence that I was provided with is authentic it proves that the Chevron contract was a done deal prior to the May 1, 2009 posting. HCC had even selected the subcontractors that would be part of the contract. There is proof that Art Tyler was meeting with representative(s) of Chevron in regards to the proposed energy contract prior to the posting.

I have come across what I believe is proof (It looks authentic but will let the proper authorities decide) that the Administration in particular Art Tyler had met with and had already discussed the Chevron Energy Solutions Contract with a representative of Chevron (Brad Boerger) prior to the Request for Proposals. Included in the information that I have received is a list of sub-contractors. The meetings and list of sub-contractors are all prior to the posting for Request for Proposals. I have requested that HCC void the Chevron contract as it did not meet the minimum 14 day requirement. I have not had a response from HCC in regards to my request. With the new information in hand I will start preparing a packet to submit to the FBI and the District Attorney, therefore I will not be posting on a daily basis while I prepare the packet.

$400 an Hour and no intent to release report

Below is the scope and agreement between HCC and the law firm to do the investigation. The attorney was to be paid $400 an hour plus expenses. Remember the lawsuit that claimed that it is how HCC cleared people and in this case convict people in the media. Here is an agreement that seems to verify what that lawsuit states that an attorney client privilege was to exist thereby preventing the release of investigation to the public. There will be more about this agreement later, but remember this is a contract that cost almost as much as HCC will save by getting rid of counselors.
